Question Can anyone give me some advice? I'm having a problem with my wages in Tenerife

Hi

Can anybody please help with a bit of info, I have been working for the same company for nearly 4 years and i think now they are now having money problems. I am still waiting for Feb and March wages.
Would it be better to walk out or give my 15 days notice etc as everytime i ask they just say nobody has been paid you need to wait a bit longer. Obv i dont want to work for free so they owe me even more money.
Anybody who knows what is the best way around it please advise me

I don't know your full story, but i think it might be wise to get some legal advice. Good luck i hope it all works out for you.

How terrible. I do not know the law, but are you not entitled to refuse to work until you are paid, you are owed two months money. Why would you give them 15 days more free work. I believe there is an employement lawyer in the Valdes Centre in Los Cristianos opposite the bus station.

I wouldn't get legal advice at this stage.

This happened to a friend of mine. Talk to your employer. After 4 years you must know them quite well. Explain your concerns and ask them what is causing the problem and whether it is likely to be rectified, and if so, when.

My friends boss told him last 'whenever' that he couldn't afford to pay him that month, that things were tight through lack of sales and also getting money in that was owed to him from other people.

He was given the option to leave or stick with it in the hope that the situation would improve. Either way, you have to be paid for the work that you have done (assuming that the nominas have been raised) It may take time but you do have to be paid eventually even if the business stops trading.

not as easy as that, we worked for same company and when we confronted them they said none of staff had been paid and everyone in the same boat we had to leave.Never been as stressed in my whole life.Not a nice experience

I would be better giving the 15 days as legally then eventually i would need to be paid.

You should be able to refuse to work without giving 15 days notice... and they legally can't sack you. You just earn nothing and do no work, but still have your contract... however check with a lawyer. Mr Yanes in Canary Sol, Los Cris, also gives free advice. His address and number are in the 'know your rights' sticky at the top of the living in/moving to Tenerife section.

Why not approach your employer and ask if they can pay everyone a percentage of their wages? Surely they can afford SOMETHING? It may not be the whole amount, but everyone has to live...

Thanks for the advise I will give him a call.
We have all approached the boss but the only answers we are getting is that theres no money at the moment, therefore we will all have to wait but 2 months now its a little unfair
