Does anyone know how a "baja laboral" works in Tenerife?

I have been off sick from work for a week now. I have a doctor's note or a "parte de baja laboral" but I don't know how it works. Please can anybody help?

I got my first parte on the 20th December, and the doctor dated it from the 19th (my first day off) and told me I had to go back on the Monday 24th December to be signed fit for work. I went on Monday only to be told by the nurse that the doctor wasn't working because it was Christmas Eve, noone else could do it so I would have to go back on Wednesday.

So I went back to the doctors yesterday 26th December (still poorly I hasten to add) and he gave me another parte de baja dated from the 22nd. As with the first there is no indication of how long I am signed off work, though the receptionist did give me an appointment automatically for next Wednesday 2nd January.

Does anyone know how long this note is effective for? Based on this note, when will they expect me back at work? Do I need to go back to the doctor for an "alta" before I go back to work? And if I should feel better before the end of my signed off period, what are the implications of returning to work early?

Actually Mike is the one who I think could answer this best. I honestly don't know, sorry. I think you need an alta for contributions purposes, and as far as I know, the only implications to returning to work beforehand will be that you won't be benefiting from social security contributions during the period of baja. But as I say, Mike will probably know more.

EDIT> I think that periods of baja are determined by the nature of the complaint requiring the baja. Without a specific list of these, it would probably be impossible to say. I think that flu is 8-10 days.

EDIT2>Apart from contributions, I think employers might be able to deduct/discount salary during periods of baja because there is a social security entitlement ... but I'm not sure about this. Have a look HERE too.

um, does that mean just being on sick leave (because of a flu or for a longer time) is not the same as being de baja?? I have never understood this system...

My understanding is that a "baja temporal" is sick leave for a period determined by a sick note.

when i was sick i had to get one every week,but make the appointment for after a week not before or you will not get it , when making the appointment tell them its for a baja and it will be ready with the doctor when you see him,everyone is numbered 1-2-3 ect and dated to continue from each other.

It all seems very complicated to me, I'd just go back to work if I felt fit enough, seems the easiest option to me

Sorry, but I haven't a clue. I'm not registered with a state doctor and my recent time off work due to illness was covered by holiday leave that was outstanding.

It is something that I think we would all be interested in knowing the answer to if anyone has the information.

You must get an Alta from your medico de cabecera in order to go back to work. The baja temporal is usually renewed weekly by your social security doctor (medico de cabecera). If you want to go back to work before the week is up just ring cita previa and they will normally give you an appointment the next day .
Telephone 922 239 301. have your nie number ready. If you don't know the name of your doctor they will tell you when you make the appointment.
