I have an employment contract in Tenerife and I have some questions...

Is there a time limit from when you receive your contract to when it has to be stamped by the relevant office and handed back to your employer, I have only just been given mine, even through the start date is 06.08.07 and have just found out that the Office in Los Cristianos no longer covers this service anymore and that I have to go to somewhere in Granadilla, does anybody know where to go.

My employer has given me a basis contract with the minimum hours stated so that medical entitlment is covered, my wage slips also state the same amount even though, I get paid weekly in cash on an hourly rate and work about 40 to 60 hours a week, if something happens where I loose my job and I need to claim against him, how can this be prooved, or is it just a case of his word against mine.

unless it is a self employment contract then your employer is supposed to do it.

as long as it is stamped with the company stamp and signed by the responable persons then it is legal and binding.

what is written on the contract is the only thing that is legal and binding.

you did have the right to have a legal representative with you when you signed the contract.

but then you may have not got the job.

The contract should be stamped within 10 days in the relevant office. When you get paid go to the bank with ALL the money (even if you need some) and tell the staff to put it in as 'nomina', this will help in the event of a claim against your employer. If you need money ask them for some after you have put it in. If your embarrassed about doing this get a card for the machine, that way you can put the lot in then go to the cash machine and draw out what you need.

We have been discussing this on another thread which you will find HERE. You can't prove anything. Any benefits will be based on what is written in your contract, regardless of the reality of the situation. You have the choice of accepting the situation or challenging it and being without a job.

Interesting info

I read all the threads associated with my question and this has prooved very interesting, it appears that regardless of the situation your employer really has got you by the short and curlies, it does not seem to matter whether it is a temporary or sub contract contract, it does not seem to matter whether you get paid more than what is stated and it does not seem to matter when you were given it, if things go wrong you just have to take the risk and only then at the last minute will you find out if what you had was correct or not as the case seems to be.

I find this a very interesting situation as I was an employer in the UK and I would never have dreamed of playing god with somebodies life or future, rules were in place and we all kept to our part of the contract.

What these employers over here seem to forget is that without the tourists (predominantly British in our industry) and the fact that we speak the English language (more than half of my colleages dont), they probably would not have a business, yet they still want to abuse us at every opportunity and because we really dont want to go back to the UK we accept this.

What would actually happen if all the British people decided to up an leave, where would that leave them then ?????

Everyone has that choice, Mick. This is Tenerife, and like it or not, this is how Tenerife is. Things are changing, but slowly. There is a strong employment law here, but it is so strongly in favour of employees that employers try to get around it. The whole thing needs a shake-up, but incomers have to work within the system to change it.

They really will have to address these issues, and I believe they know this. But what they do not have to do is make changes just because we want to come here and don't like what we find.

Just noticed your thread.

I had the same problem to a few months ago, I work 40 hours but when my contract came ithrough it only showed as 10 hours.

I did question it and was told by my boss to either like it or lump it, there were plenty of other people willing to do my job if I did not want it.

In the end, I had to put up with it - a small contract is better than no job!



Unfortunately its the way with a lot of companies over here; so long as you have some sort of contract to be legal you will get given the minimum. There ain't much you can do about it, except go along with it if you want to stay.

Its part and parcel of life here!!!

please could anyone help me to sort out my works contract .i have a 3 month contract which expires on 4th sept. i have given 11 days notice to finish work on the last day of my contract .my boss wants me to finish 2 days before my contract ends does this mean that he gets out of paying me holiday pay ? .this is presuming that i am entitled to 11 days nobody seems to know exactly how these contracts work .mine is the usual type ,i work over 40 hrs a week in a kitchen & my contract is for 20 hrs waitressing how bizzare !!.i have 4 days left to sort this out & would really appreciate some help x
