What are the laws regarding living in garages & storerooms in Tenerife?

anyone know which laws aply to this? can someone convert their garage on a community into living accommodation?

Oh dear this might look like I am stalking you for which I apologise but we apparently have such a situation on a nearby complex unless it has been resolved recently. The President was negotiating with the garage owners to remove the "accommodation"

The conversion would be illegal under the Law of Horizntal Division without the absolute majority of the owners. so in effect as I understand it it would only require 1 owner to object and permission would be denied. If you want the reference and actual article I can dig these out later.

Also any works without the required building licences would also be illegal.

Not sure if we are talking the same complex, but several years ago a friend of mine was going to purchase a studio on the front (lower end) of Port Royale, only to discover that all of this line of studios were legally garages. Possibly all corrected now, but maybe not. (and no he didn't buy)

This is being discussed too on a complex in Palm Mar, where garages underneath apartments have been converted into living space - you will not be surprised to hear that the selling agents told the prospective owners that it was perfectly okay to do so ... now they Community are requesting that all be returned to garage/storeroom use.

Surely anyone who bought the houses would have checked on the nota simple as to what the property consisted of??? ie garage referred to as a garage not an extra room.... rather than just believing an estate agent?

Welcome to the world of Tenerife, where we have often noted that people leave their brains on the plane before disembarking into the sunshine

I bought on that complex in Palm Mar too, except it was a penthouse. When I checked the paperwork, it said "buhardilla" for where the two bedrooms are (think "attic") - they had no idea what it meant and went to the developers to ask ... surprisingly, even though it is not legal living space, it has been valued by the bank as being so. And the definition of the space can be changed in the escritura after 4 years.

On another complex nearby, a different agent was openly saying the roof terrace was intended to be converted to another bedroom - the Community are now trying to have additional works done by owners removed.

Moral - check with a lawyer/architect/the Town Hall or someone knowledgeable not about to earn commission from the property sale before you contemplate making such changes - it could be very costly otherwise.
